These Terms of Use ("Terms") govern your use of moldresponsepros.com (the "Site") and the call-connection service offered on it (the "Service"). The Site is operated by Element One GmbH ("we", "us"). By using the Site or calling the number displayed on it, you agree to these Terms.

1. What the Service Is — and What It Is Not

The Service is a free call-connection service: when you call the number on the Site, we route your call to an independent local mold remediation professional or a call marketplace covering your area. We are not a mold remediation contractor. We do not perform, supervise, warrant or guarantee any remediation, inspection or repair work. We may receive compensation from professionals or call networks for connecting calls.

2. Independent Professionals

All professionals you are connected with are independent businesses. They are solely responsible for their qualifications, licensing where applicable, pricing, workmanship, scheduling and any agreement you enter into with them. Any contract for services is exclusively between you and the professional. We do not endorse, recommend or vouch for any particular professional, and availability varies by area and time.

3. Calls, Recording and Consent

By calling the number on the Site, you consent to being connected with an independent professional or call network, and you acknowledge that calls may be recorded and monitored for quality assurance where permitted by law. Standard carrier charges may apply. Calling the Service does not create any obligation to purchase anything.

Content on the Site is general information about mold and professional remediation. It is not medical, legal, insurance or engineering advice. For health concerns, consult a qualified medical professional. For insurance coverage questions, consult your insurance provider or policy documents.

The Site, including its text, design and branding, is owned by or licensed to Element One GmbH and protected by applicable intellectual property laws. You may not reproduce it without our prior written consent.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEMENT ONE GMBH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM SERVICES PERFORMED BY INDEPENDENT PROFESSIONALS, YOUR RELIANCE ON SITE CONTENT, OR YOUR USE OF OR INABILITY TO USE THE SERVICE. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE (THE SERVICE IS FREE TO CONSUMERS). NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING MANDATORY CONSUMER PROTECTIONS OF YOUR STATE OF RESIDENCE.

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Site or Service or your violation of these Terms.

These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to any mandatory consumer protection laws of your state or country of residence that apply regardless of choice of law.
